1. Who we are
Diam Art Ltd (“Diam Art”, “we”, “us”, “our”) is a company incorporated in Israel. We develop the DiamCut Pro software, operate the website diamcolor.com, and are responsible for the data described in this policy.
This policy supplements Section 9 (Data Collection and Use) of the DiamCut Pro End-User License Agreement (the “EULA”). It applies to DiamCut Pro for Windows and macOS, to the online services on which the software relies, and to this website.
2. Data collected by DiamCut Pro
DiamCut Pro relies on Diam Art’s servers to operate. In the course of normal use, it transmits the following categories of data over encrypted (HTTPS) connections.
a. License and device data
- Your license key and edition.
- A machine identifier: a short code derived by a one-way calculation from your computer’s hardware. It does not contain your computer name or user name.
- The DiamCut Pro version, the operating system version, and integrity values that identify the exact build installed.
- Usage counts for optional features.
- The IP address from which each request is made, which our servers record automatically.
This data is transmitted when the software starts, when it is activated and when it checks for updates. It is used to verify that each installation is a genuine, registered copy and to make updates available.
b. Diagnostic data
- Crash and error reports, transmitted automatically when the software encounters a failure. These include technical error details, a short excerpt of the application log, the name of the open file, and basic system information such as the operating system and graphics capability.
- Bug reports submitted through Help > Report a Bug. These include your description of the problem, a screenshot of the application window, an image of the 3D view and the current project.
c. Design and project data
- Stone models opened in the software, including GemCad (.asc) and Sarine (.srn) data.
- DiamCut Pro project files (.dcpro) and their contents: facet geometry, edit history, rendered images and thumbnails, reference models, color settings and file names. A copy of the project is uploaded each time it is saved. Before upload, all folder locations are removed from the project; only file names are retained.
- Rendered images of the stone, transmitted to compute color maps and metrics.
d. Content you choose to send
- Share links: the stone model and any photographs, notes and results you elect to include. Anyone in possession of the link can view its content.
- Cutting plans, analysis requests and photo color analyses: the project, photograph or plan submitted, together with any email address or note you provide.
- Explain: numerical results and brief labels, used to generate a plain-language explanation (see Section 5).
3. This website
- Contact form: your name, company, email address and message, used solely to respond to your inquiry.
- Visit statistics: we use Metricool, a web analytics service, to measure visits, the pages viewed and the sites from which visitors arrive.
- Fonts: pages load their fonts from Google Fonts, which receives your IP address in order to deliver them.
4. How we use data
We use the data described above to:
- provide DiamCut Pro, activate licenses and verify that each installation is genuine;
- compute server-side results such as metrics, color maps and analyses;
- diagnose and correct errors;
- develop and improve DiamCut Pro and its functions;
- respond to inquiries, administer billing and comply with our legal obligations.
Under the EULA, you grant Diam Art a license to use this data for these purposes. You retain full ownership of your designs.
5. Access and disclosure
Design and project data is stored on Diam Art’s servers and is accessed by our staff only when an error has been flagged. We treat this data as confidential and do not sell, publish or disclose it to third parties, except where required by law.
The Explain feature may use one of the leading third-party AI language models to generate its explanation text. Only the numerical results and brief labels required for the explanation are provided for this purpose. Stone geometry, images, project files and file names are never included.
6. Security
All communication between DiamCut Pro and our servers is encrypted in transit, and project files are stored in an encrypted format. Access to our servers is restricted to authorized Diam Art personnel. Although no system can be guaranteed to be completely secure, we apply appropriate measures to protect your data and will notify affected customers without undue delay if a security incident puts their data at risk.
7. Data retention
Design and project data, rendered images and diagnostic reports are retained for 30 days. Unless an error has been flagged within that period, they are then deleted automatically from our servers. Data associated with a flagged error is retained until the error has been resolved, and is then deleted.
License and device data is retained for the duration of your license and thereafter for as long as required to meet our legal and accounting obligations. Content you choose to send, such as Share links and analysis requests, is retained for as long as necessary to provide the service you requested.
Residual copies held in routine server backups are overwritten as those backups rotate.
8. Your rights
Subject to applicable law, you may request that we:
- confirm whether we hold personal data about you and provide you with a copy;
- correct any data that is inaccurate or incomplete;
- delete your data before the end of the retention period, unless we are required by law to retain it.
These rights are provided under the Israeli Protection of Privacy Law, 5741-1981, and, where applicable, the EU General Data Protection Regulation and the UK General Data Protection Regulation. You may also lodge a complaint with the Israeli Privacy Protection Authority or with the data protection authority in your country of residence.
9. Changes to this policy
We may update this policy from time to time. The current version will always be published on this page with its effective date. Material changes will also be reflected in the DiamCut Pro license agreement presented when the software is installed or updated.
10. Contact
For questions or requests regarding your data, please contact Diam Art Ltd through the contact form or by email at gonen@diam-art.com.
